A rule of law judge believes that the interpretation of statues and constitutions must be based on a search for the lawgiver’s intent – that interpreting the law must be more principled than what an individual judge feels is a good outcome. A rule of law judge believes that a judges proper role is to determine what the law is, not what an all powerful judiciary believes the law ought to be.

An activist judge is unwilling to let the text of the law be the sole guiding principle for constitutional or statutory construction. If a judge lets their own personal views taint their decision, then they wont be making decisions based upon the law. Instead they will be making decisions based on who they believe is the more sympathetic party, not the party who has the better legal argument. That my friends is not democracy. That is government by judicial fiat.
